Díaz-Canel affirms that Cuba will have a modern Family Code

Havana, 20 may.- The First Secretary of the Communist Party and President of the Republic, Miguel Díaz-Canel Bermúdez,pleaded for a code of Modern Families, which meets all constitutional precepts and really constitutes a step forward in the concept of family in Cuba, at the head of a meeting at the Palace of the Revolution with the Commission created to prepare the draft of this important legal provision.
In this first meeting, the president explained that there will be systematic meetings of the Commission and with its subgroups, to evaluate and debate what is being done.
In all the work that we do, he clarified, regardless of the body of the Code itself, we have to see the elements of assurance, how the discussions will be carried out, the social communication strategy, in order to carry out this debate with the greatest possible unity.
Reflecting on the Family Code, Díaz-Canel specified that it will be held for debate and a referendum due to its significance, because they are issues with a very broad conception, which encompass our entire society; We are not just talking about equal marriage, it is much more. We will not be bringing the issue of equal marriage to a debate or a referendum, we will be bringing the issue of families, he clarified.
The Minister of Justice, Oscar Silvera Martínez, explained that the Policy approved for the development of the new Family Code responds to a constitutional mandate, specifically the Eleventh Transitory Provision, which indicated the need to develop and approve it. In addition, it defends the necessary coherence that this Family Code must have with the constitutional text and with the international treaties that our country has ratified.

Silvera Martínez pointed out that the Policy establishes the need to adapt the current regulations to the characteristics of Cuban society and the characteristics of our families; and, of course, it takes into consideration the results of comparative law studies in Ibero-America and other countries. I can affirm, he said, that the Policy and the Family Code project proposals that we have worked on have a lot of science, knowledge, years of research, analysis, study in our universities, in our institutions.
The Minister of Justice added that in the entire previous process, 21 fundamental problems were identified –which currently have solution proposals–, mostly related to marriage and de facto union; issues of filiation; parental relationships, and institutions of care and protection.
Silvera Martínez explained that, even in the midst of the pandemic, they have been working in parallel with the Policy and there is already a very advanced version of the preliminary draft of the Code.
At the meeting, where the President of the National Assembly, Esteban Lazo Hernández, and Prime Minister Manuel Marrero Cruz were present, a work schedule of the Commission for the coming months was evaluated and the discipline of the times was insisted not to compromise the success of the process.
